While the Bahamas does employ the British Common law developed during
its period as a colony; it has not fully adopted the British Registry
system and still operates its land records as a grantor-grantee
recording system. Despite a common language and the use of a
recording system, title matters differ significantly from those in the
U.S. The use of title agents in the jurisdiction allows a potential
investor, lender or purchaser the opportunity to work with a local
expert who understands the laws and regulations regarding real estate
transactions and speaks the common language of title insurance to help
customers bridge the gaps of knowledge and understanding of local real
estate practices and customs.
